Ciudad de México, y el Gobierno AxigiÓ un depósito de $8,000 para garantizar su terminación, habiéndose dado fianzas par I icula.res. Al adquirir la. actual Empresa. la. propiedad en J887, sólo se había construido la. mitad de la línea., entre el punto terminal del Nacional Mexicano en la extremidad occidental, al del Ferrocarril Interoceánico en la parte oriental, conectando éstos con los Ferrocarriles Mexicano, Uentral Mexicano, Hidalgo, y Cuerna.va.ca y el Pacffico; los dos Últimos de los cuales se internaron é. la Ciudad después de construida la línea de Cintura.. El tramo concluido ha da.do y está dando buenos re• sulta.dos, pero se creía que la parte restante, si se construyera., no podría ex¡1iota.rse con provecho, y en consecuencia se dejÓ expirar el plazo sefia.}ado para. su ·conclusión. El Gobierno declaró caduca. la. concesión por lo que concernía á la. mitad no efectuada., y la Empresa perdió la parte del depósito correspondiente á ese tramo. La partida. "fianza. del F~rrocarril de Cintura." en el estado que anteceie, á saber: $3,200 moneda. americana, la que al t.ipo arbitrario de conversión empleado en estas cuentas, es equivalente á $4,000 moneda mexicana, r epresenta el pago hecho por esta. fianza.. La concesión de la línea. entre Matamoros y un punto de la. vía troncal del N aciona.l Mexicano, ha sido cancelo.da por lo que toca. á la. parte no construida., habiendo y a expirado el plazo señala.do para su construcción. Esta Empresa, al adquirir la propiedad no asumió obligación alguna. de terminar esta línea, y en consecuencia la. ca.ncela.ción parcial de la concesión no im• plica ninguna pena. The concession for your Cintura roa.d contemplated its construction entirely around the City of Mexico, anda bond in the sum of $8,000 was required by the government as security for its completion, which was given with individual sureties. At the time you. took over the property, in 1887, only about ha.lf of the line was completed, extending from the Mexican . The government declared the concession forfeited so far as it a.pplied to the unfioiehed half, and, a.llowing credit upon tbe bond for tbe completed half, forfeited the remainder. Tbe item "Bond Forfeited" in the a.hove sta.tement for $3,200 in United Shtes currency, whicb, at the arbitrary rate of conversion used in these accounts, is the equivalent of $4,000 in M.exica.n currency, represente the payment upon this bond. Los que se enajenaron comprendieron 108 carros lijeros del estilo antiguo, y los nuevos son del tipo moderno, con capacidad de 40,000 libras, dando por resultado que el material actual tenga á la vez mayor valor y más capacidad. Los productos del tráfico local di:muestran un aumento de 4 pg. El mayor volúmen de impor~acionee fué anormal, y se-debió principalme·n te á las entradas de maíz extranjero, q ue se hicieron con motivo de la sequía que prevaleció en 1896 en muchse partes de la República y aftc!Ó gravemente las consechas nacionales, aunque no basta el mismo grado que en 1892. EL CONVENIO DE TRAFICO. NO podemos explicarnos en qué se funda la oposición que algunas personas ofrecen al proyecto de ley sobre la extradición, que se discute en la Cámara de Diputados. Parece que el mayor ar,;rumento en contra de esta medida es el de que autoriza la detención de un acusado mientras se reciben las pruebas docuwentales de su culpabilidad, curso que se considera estar en conflicto con el pre.,.epto constitucional de que no se puede tener preso á na.die por más de 72 horas sin que recaiga el auto de formal prisión. Pero los que aducen este arii:umento han hecho á un lado el principio, que es ca.id un axioma, asentado por Marshall, de que las ¡ptrantías constitucionales tienen por objeto la protección de los que deben ser juzgados por los Tribunales nacionales, y no amparan á los que, conforme á un tratado internacional, deben ser entregados á las autoridades de otra nación para ser procesados allí. Si no existiera. este principio sería impracticable la extradición, y la objAción mencionada no sólo critica. una dis posición de la ley proyectada, sino que realmente constituye una censura. radical del principio de extradición. Naturalmente, la detención provisional de presuntos r eos mientras so rec,iben los documentos respectivos, ha si·!o efectuada en todos los casos en que este Gobierno ha concedido la extradición; así es que las objeciones puramente teóricas de los adversarios de la ley general de .extradición son, cuando-menos, algo tardías y forzadas. Nosotros creemos que la nueva medida será de utilidad, puesto que no sólo reglamenta. en términos claros y uniformes los procedimientos preliminares para la entrega de acusados, sino que también sanciona. legislativa.mente tal entrega en casos en que no existan tratados. Además, da amplia protección á las personas acusadas. Sus proced imientos abrazan tanto los principios judiciales como los administrativos, destruyendo así los inconvenientes que causaría. el empleo de uno sólo de estos métodos. El judicial aisladamente, si abarca más que un exámen de las eircunstancias gene • ralee del caso, ó tiene que ser incompleto, Ó debe prejuzgar el caso del d etenido. Por otra parte, ei Ejecutivo, obrando por sí sólo y sin consejos judiciales, adolecería de la tendencia de decidir las cuestiones de extradición ob3deciendo más á razones de estado que á principios legales. Ambos defectos se obvian por la iniciati va de ley, la que asigna á los Tribunales la decisió n de dos Ó tres cuestiones bien definidas r elativas á una ~olicitud de extradición, sometiendo, siu embarg o, tal dictámen á la aprobación del E¡ecutivo. En consecuencia, el Presidente, aunque será guiado en la mayor parte de los casos por las indicaciones legales que establece la proyectada ley, no estará obligado á seguir las decisiones i udiciales cuando la. razón de E stado y la conveniencia nacional exijan lo contrar io. Pero en todo caso la ley concede á los presuntos reos el supremo recurso clel amparo, siempre que se pida dentro de los tres días siguientes á la notificación del dictámen que acuerda su extradición. Además, la iniciativa mencionada prohibe la extradición de personas acusa.das de delitos que no es~n penados por las leyes de .Uéxico, Ó que se castigan con una vrisión menor de un afio, ni po~ cuestiones de política ó de religión, y dispone que deben presentarse presunciones de culpabilidad tan fundadas como se necesitarían para justificar la aprehensión y detención del An lMradition Law. IT is really rather hard to understand t,h e opposition which tbe extradition bill now b efore the Chamber of Deputies has aroused in certain quarters. The ca..pital objection to tbe measure seems to b e that it authorizes the holding of a culprit pending tbe receipt of the documentary proof of his guilt, a practica wb.i ch is apparently at varia.neo with tbe constitutional precept that no one can •be held in confinement for more than three days without a judicial warrant setting forth tbe charge on which the prisoner is held. The persone urging this objection seem to ha.ve overlooked the almost axioma.tic principie enunciated by Marshall, viz., that constitutional safeg uards ar e intended for culprits who are to be tried in domestic courts and do not apply to those who by virtue of an international contract are to be surrendered for trial by tbe courts of another nation. Extradition would b e imposeible on any other principie and tbe objection a.lluded to does not involve merely a detail of the propo@ed law,but implies in practica a total condemnation of the prinlliple of extradition. The precautionary holding of delinquents pending the arrival of papera has ofcourse been resorted to in every case in which extradition has hitherto been granted by the Mexican Government, so that the purely speculative objections of the opponents of tbe general extradition law are to eay the least somewhat tardy and extemporaneous. To us it seems that the measure will serve an useful purpose, as it not only lays down clear and uniform rules as to the legal preliminaries for the surrender of delinqnents but aleo gives legislativa sanction to their surrender in the absence of treaties. Moreover the safeguards which it afforde to culprits are ample. It adopte the mixed judicial and administrativa method, thus obviating the drawbacks to either method taken singly. The judicial method alone, if it involves more than a consideration of the broad circumst ances of the case, must either beoi.ncomplete or must prejudge the accusation against the person held for extradition. On the other hand, the Executive acting alone and unadvised, is apt to be guided, in granting or denying extradition, rather by reasons of Sta.te than by the legal as pecte of tbe case. Both of these drawbacks are overcome by tbe process embodied in the bill, which submits two or three clearly defined questions, bearing on the application for extradition, to judicial decision, but _rendare sucb decision subject to Executive rev1s10n. Tbus while the President will in the i.ilajority of cases follow the legal guida.nea provided by the proposed law, he will not be so rigidly bound · by judicial decisions a.e to be debarred from acting on broad principies of statesmanship and na.tional expediency. But in any event the law lea.ves open to culprits the suprema recourse of amp aro, provided it be sought within three days from the time when the culprit is notified of the decision granting bis extradition. Es cierto que los Comisarios tienen cierta libertad, de que rara vez abusan, pero frecuentemente sucede que los secretarios y otros empleados subalternos, en ausencia de los Comisarios, convierten desavenencias triviales en casos graves, causando muchas molestias á los ciudadanos industriosos, y agravando los trabajos de los Tribunales á donde se consignan' disputas que cualquier hombre de recto criterio ajustaría en cinco minutos. Todos los abogados de primer rango procuran siempre arreglar los negocios de sus clientes obedeciendo al sentido común, evitando recurrir á los Tribunales, pero los empleaditos meticulosos son el a.zote de la humanidad y andan siempre á ca.za de pleitos. En las exportaciones hubo una diminuci6n de $894,832, siendo los totales de $48,798,156 en la primera mitad de 1896-97, contra $49,692,988 en el correspondiente semestre de 1895-96. Los metales preciosos exportados tuvieron un ligero aumento de $231,512, que se debió principalmente á las mayores remesas de p]nta en pasta. Pero la exportaci6n de otros artículos acusa una reducción de $1,126,344, originada en su mayor parte por el decrecimiento de las remesas de ganados ($1,057,496) y de café ($974,463), siend0 insignificante la reducci6n en los demás efectos. La reducci6n en los dos artículos mencionados fué en parte compensada por un notable aumento en la exportación del henequén, ascendiendo á $461,306, y en la de raíz de zacat6n ($313,982) y de tabaco en rama ($423,261). The statistics of Mexico's foreign trade during the first balf of tbe current fiscal yea.r are of grea.t interest. An interim dividend of 3s. per share was paid last September, and tbe µirectors now recommend that a furtber dividend of 5s. per share be paid, making a total distribution for the year 1896 of 8 per cent., free of income-tax.
